An Australian policy. In plain English.

ABird is an Australian business, operated from Melbourne, serving Australian founders. This policy is written under Australian law. The Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles. It is governed by the law of Victoria. It explains what we collect, why, where it goes, how AI fits in, and what you can do about it. Without the legalese.

The short version.

  • We are Australian. Our business, our jurisdiction, and our obligations are Australian.
  • We collect only what you give us when you take the Birdie Score, book a call, or email us. No buying data. No scraping.
  • Some of the tools that make our site work (Calendly, Stripe, Webflow, Google Fonts) are based overseas. We tell you exactly where your data goes and why, because Australian Privacy Principle 8 requires it.
  • We use AI to help interpret patterns in your Score. A human (Pano) reads every output before anything personal goes back to you.
  • The Birdie Score is a diagnostic. It is not personal financial advice. It does not replace your accountant.
  • You can ask us what we hold, ask us to fix or delete it, and complain to the Australian regulator (the OAIC) if we let you down.

Who we are.

This site is operated by ABird Diagnostics Pty Ltd (ACN 696 504 499), an Australian company, as trustee for the Little Birdie Trust (ABN 48 664 476 062), trading from Melbourne, Victoria. ABird Diagnostics provides financial diagnostics for Australian founder-run businesses. It names patterns in how money moves through a business. ABird Diagnostics is not a registered financial adviser and does not hold an Australian Financial Services Licence.

Tax agent services, where engaged separately, are provided by Pano Pongas (Registered Tax Practitioner 24728014, Australian Tax Practitioners Board) trading through PVP X Pty Ltd. ABird Diagnostics and PVP X are related parties under common control but provide distinct services under distinct engagements. PVP X tax agent work is governed by the Tax Agent Services Act 2009 (Cth) and the TPB Code of Professional Conduct. This policy covers what happens on this website and through the Birdie Score and Diagnostic Call flow.

Who we are built for. ABird is designed for Australian businesses. If you are accessing this site from outside Australia, you can still use it, but the services, regulators, and protections referenced here are Australian.

What we collect.

When you take the Birdie Score

  • Your answers to the 12 questions. No bank statements, no financial documents, no MyGov data.
  • Your email if you choose to receive the result, plus first name and business name.
  • Basic technical information. Your browser type, the page you came from, approximate location from your IP address. Collected automatically by our analytics.

When you book the $49 Diagnostic Call

  • Name, email, business name, and a short free-text question, captured by Calendly.
  • Payment details captured and processed by Stripe. We never see or store your full card number.
  • Anything you choose to share with Pano during the 25-minute call itself.

When you email us

  • Whatever you put in the email, plus your email address and anything visible in the email metadata.

Where your data actually goes.

We are an Australian operation, but some of the tools we rely on to run the site and the booking flow are based overseas. Australian Privacy Principle 8 requires us to tell you where, so:

  • Calendly (United States). Handles diagnostic call bookings and the questions captured on the booking form.
  • Stripe (United States, with regional processing). Handles the $49 payment and stores card and billing data. Stripe maintains AU-specific compliance practices for Australian merchants.
  • Webflow (United States). Hosts this website. Form submissions on this site are processed through Webflow infrastructure.
  • Google (United States). Hosts Google Fonts loaded by this site, which involves a request from your browser to Google servers.
  • Analytics. If and when we add Google Analytics or a similar tool, that data is also processed in the United States. We will update this policy before turning it on.
The plain read. The infrastructure providers above are based in the United States. We use them because they are the established standard for what we are doing as a small Australian business. We are not pretending the data is Australian-sovereign and we are not hiding the disclosure. If full Australian sovereignty matters to you, please tell us before booking. We will discuss whether ABird is the right fit.

How AI fits in.

We use AI in two places. Telling you so you can decide what that means for you. This aligns with the Department of Industry, Science and Resources Australia AI Ethics Principles (voluntary, 2019), particularly the principles of transparency, accountability, human oversight, and contestability.

In how the site is built

This website was built and refined using AI-assisted coding tools (Anthropic Claude). No personal data of users is sent to AI tools during the build process. Build is build.

In interpreting Birdie Score results

When you complete the Birdie Score, your answers may be processed through AI to help identify which patterns from a defined library are present. A human (Pano) reviews every output before anything personal is sent back to you. The AI does not generate personal financial advice or personal tax advice. It names patterns. Pano is the one who reads your result, and Pano is responsible for what gets said back to you.

What this means in practice. Your Score answers may be processed by Anthropic (United States) or similar AI providers as part of generating your result. We do not train any AI model on your data. We do not sell or share your data with any AI provider beyond what is needed to process your specific result. You can opt out of AI processing by emailing us. Your result will then be interpreted manually by Pano without AI assistance, which may take longer.

If at any point you believe an AI-generated output about you is wrong, you can ask us to review it. A human will. We will tell you what we changed and why.

What we use it for.

  • Returning your Birdie Score result and the Financial Reality Snapshot.
  • Running the $49 Diagnostic Call you booked and following up on it.
  • Sending you occasional emails about ABird if you have opted in. Unsubscribe link is in every email. Required by the Spam Act 2003 (Cth) and we honour it.
  • Understanding how the site is used in aggregate so we can improve it. No individual is identified in those reports.
  • Meeting our legal obligations. The Privacy Act, the Tax Agent Services Act (for PVP X work, separately), Australian Consumer Law, the Spam Act, and the Notifiable Data Breaches scheme.

We do not sell your data. We do not buy data about you. We do not run targeted advertising.

Cookies and analytics.

This site uses essential cookies needed to make the page and the booking widget work. It may also use analytics cookies that count visits and tell us which pages are read. You can decline non-essential cookies through your browser settings. The site will still work. If we add a cookie banner in the future, you will be able to manage your choices there.

How long we keep it.

  • Birdie Score answers and email. Kept while you are subscribed, plus 12 months after you unsubscribe, then deleted unless you ask us to keep it.
  • Diagnostic Call bookings and call notes. Kept for 7 years to meet Australian record-keeping obligations applicable to professional services.
  • Tax agent records (PVP X). Retained under the separate obligations of the Tax Agent Services Act 2009 (Cth). Typically a minimum of 5 years.
  • Stripe and Calendly retention is governed by their own published policies (linked at the bottom).

Security.

We use reputable providers (Webflow, Calendly, Stripe, Google) with established security practices. Payment data is encrypted in transit and at rest by Stripe. We restrict internal access to your personal information to people who need it for the work. No system is invulnerable. If we ever discover an eligible data breach affecting your data, we will notify you and the Office of the Australian Information Commissioner in line with the Notifiable Data Breaches scheme.

Your rights under Australian law.

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you can ask us to:

  • Show you what personal information we hold about you. Australian Privacy Principle 12.
  • Correct it if it is wrong, out of date, or incomplete. Australian Privacy Principle 13.
  • Delete it, except where we are legally required to keep it (for example, tax records held by PVP X under separate statutory obligations).
  • Stop us from contacting you. Email opt-outs are in every email. For phone or other contact, just ask.
  • Have an AI-generated output about you reviewed by a human. See the AI section above.

Email hello@abird.com.au with what you want done. We aim to respond within 14 days, in line with OAIC guidance.

If you are not satisfied with how we handle a privacy issue, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or call 1300 363 992. We would rather you talk to us first so we have a chance to fix it.

The advice line, drawn.

Important. Australian context. The Birdie Score and the $49 Diagnostic Call are diagnostic services. They name patterns. They do not constitute personal financial product advice under the Corporations Act 2001 (Cth), do not require an Australian Financial Services Licence, and are not personal tax advice under the Tax Agent Services Act 2009 (Cth). They are not a substitute for your accountant, financial adviser, lawyer, or other licensed Australian professional. If your situation requires regulated advice, ABird Diagnostics will tell you so and refer you appropriately.

Where you separately engage Pano Pongas through PVP X Pty Ltd for tax agent services, those services are governed by PVP X own engagement letter and Pano obligations under the Tax Agent Services Act 2009 (Cth) and the TPB Code of Professional Conduct.

Governing law and jurisdiction.

This policy and any privacy matter arising under it are governed by the laws of Victoria, Australia, and the federal laws of the Commonwealth of Australia. Any dispute is subject to the non-exclusive jurisdiction of the courts of Victoria.
